1.Who we are
Pensibly is provided by Movild, LLC (“Pensibly”, “we”, “us”). Contact: support@pensibly.com.
2.App license
The app is licensed, not sold, to you. If you obtained it from the App Store, your license is governed by Apple’s standard EULA, which forms part of these Terms. If there’s a conflict about that version’s app license, Apple’s EULA prevails. On other platforms, your use is governed by these Terms and the conditions of the store where you obtained the app.
For versions obtained from the App Store, you acknowledge that these Terms are between you and Pensibly, not Apple; that Apple is not responsible for the app or its content and has no obligation to provide maintenance or support; that Pensibly, not Apple, is responsible for any third-party intellectual property claim; and that Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
3.Using the app and your account
You can use Pensibly without an account. Some features (cloud backup, AI, syncing your plan) require Sign in with Apple. You must be at least 13, or the minimum age in your country, and have a parent’s or guardian’s permission if you’re a minor.
You’re responsible for activity on your account and for keeping your device and Apple Account secure.
4.Plans and auto-renewable subscriptions
Pensibly offers a free Free plan and the following paid plans as monthly auto-renewable subscriptions. In the App Store, paid plans belong to the same subscription group:
- Pensibly Lite — 1 month — US$9.99 per month as the reference price. The store displays the final price in your currency and applicable taxes before confirmation.
- Pensibly Plus — 1 month — US$15.99 per month as the reference price. The store displays the final price in your currency and applicable taxes before confirmation.
- Pensibly Pro — 1 month — US$49.99 per month as the reference price. The store displays the final price in your currency and applicable taxes before confirmation.
- App Store purchases: Apple charges your account at confirmation of purchase and handles monthly automatic renewal. Cancel renewal before the date shown by Apple in Apple subscription settings.
- Google Play purchases: Google processes payment with the method associated with your Google account and charges at the beginning of each billing period. Monthly renewal continues until you cancel before the next renewal in Google Play subscriptions.
- If you cancel renewal, you keep access for the period already paid for under the store’s conditions. Deleting the app or your Pensibly account does not cancel a subscription from either store.
- In the App Store, upgrades take effect immediately and Apple prorates the period; downgrades take effect at the next renewal. In Google Play, the effective date and any charge or adjustment depend on the replacement option and are shown by the store before confirmation.
- For App Store purchases, request refunds from Apple at reportaproblem.apple.com; Pensibly cannot issue them. For Google Play purchases, see Google Play’s refund policy or contact us for assistance. Your applicable statutory rights are preserved.
- If we change a price we’ll notify you in advance. Apple or Google will handle notices and consent when required by their rules or the law.
Each plan’s limits and features are described in the app and on our pricing page. “Unlimited” AI features are subject to fair use of up to 3,000 requests per month to prevent abuse.
5.Your content
Your notes, drawings, files and recordings are yours. We claim no rights over them. To provide the features you request (cloud backup or AI) you grant us a limited, worldwide, non-exclusive license to host, process and transmit that content, only for that purpose and only as long as needed to provide the service.
You’re responsible for having the rights to what you import or upload (for example, PDFs or lecture recordings) and for following your institution’s rules on recording and use of materials.
6.Artificial intelligence features
Summaries, quizzes, flashcards, chat answers, exams and grades are generated automatically and may contain errors or omissions. Review them before relying on them. They don’t replace your teachers or professional advice.
Use AI to learn and follow your institution’s academic integrity rules. How we process content sent to AI is explained in our Privacy Policy.
7.Acceptable use
You may not use Pensibly to:
- break the law or infringe others’ rights, including intellectual property;
- upload illegal content, content that exploits minors, or content inciting hatred or violence;
- attempt unauthorized access to our systems, circumvent usage limits, reverse-engineer the service or automate requests abusively;
- resell or redistribute access to AI features.
We may suspend accounts that break these rules.
8.Pensibly’s intellectual property
The app, its design, code, the Pensibly name and logo belong to Movild, LLC or its licensors. These Terms don’t give you any rights to them other than the license to use the app.
9.Availability and changes to the service
We work to keep Pensibly running, but online features may be interrupted for maintenance or reasons beyond our control. We may improve, change or discontinue features; if we remove a core feature of a paid plan we’ll let you know in advance. We recommend exporting important notes periodically.
10.Warranties and limitation of liability
To the maximum extent permitted by law, Pensibly is provided “as is” and “as available”, without warranties of any kind, express or implied.
To the maximum extent permitted by law, we won’t be liable for indirect, incidental, special or consequential damages, or for loss of data or academic opportunities. Our total liability is limited to the amount you paid for Pensibly in the 12 months before the claim. Nothing here limits rights that consumer protection laws in your country don’t allow us to limit.
11.Termination
You can stop using Pensibly and delete your account anytime. We may suspend or close accounts that violate these Terms. Sections that by their nature should survive (content, intellectual property, limitation of liability and governing law) survive termination.
12.Governing law
These Terms are governed by the laws of the State of Delaware, United States, without prejudice to mandatory consumer protection rules of your country of residence. Before filing a claim, please contact us so we can try to resolve it in good faith.
13.Changes to these Terms
We may update these Terms. For material changes we’ll notify you in the app or by email before they take effect. If you keep using Pensibly afterwards, you accept the new version.
